MarkVPN — Terms of Use

These Terms govern your use of the MarkVPN mobile application (“the App”), operated by MarkMint Tech (“we”, “our”, “us”). By downloading, installing or using the App you agree to them. If you do not agree, please uninstall the App.

1. No account is required

MarkVPN has no sign-up, no login and no passwords. You do not give us your name, email address or any other identifying detail in order to use it. Your device is identified only by a random value generated on the device itself, which is erased when you uninstall the App.

2. Who may use it

• You must be at least 13 years old (16 in the EEA and the UK).
• You must be legally able to enter into this agreement where you live.
• You must not be barred from receiving the service under any law that applies to you.

3. What the service is

MarkVPN encrypts your device's internet traffic and routes it through a server you choose. It protects your traffic from the network you are attached to. It is not anonymity software, it does not make you untraceable, and it does not protect you from anything you choose to install, sign into, or give your information to.

4. Acceptable use

You are responsible for what you do through the VPN. You must not use the App to:

• break any law that applies to you or to the server location you choose;
• send spam, malware, or run attacks, scans or intrusion attempts against any system;
• infringe copyright or other intellectual property rights;
• harass, threaten, defraud or impersonate anyone;
• access or distribute material involving the abuse or exploitation of children;
• resell, redistribute or share access to the service;
• interfere with the service, reverse engineer it, or attempt to reach any part of our systems you were not given access to.

We may suspend or block access immediately, without notice, where we reasonably believe this section has been breached or where a host, network or authority requires it of us.

5. Free use and subscriptions

MarkVPN is free to use and shows advertisements. An optional subscription removes advertisements and unlocks the premium server locations.

Prices are shown in the App before you buy, and may differ by country. We may change prices for future periods; a change never applies to a period you have already paid for.

6. Refunds

Purchases are processed entirely by Apple and Google. We do not take payments, we cannot see your payment details, and we cannot issue refunds. Refund requests go to Apple or Google under their own policies, and their decision is final.

7. Advertising

Free use is funded by advertising. Ads are supplied by third-party networks that operate under their own terms and privacy policies. We do not control which specific ads you are shown. What those networks collect is described in our Privacy Policy.

8. Availability

We work to keep the service running, but we do not promise it will be uninterrupted or error-free. Servers may be slow, unavailable or withdrawn. Some networks and some services actively block VPN traffic, and we cannot guarantee access to any particular site, service or country.

9. Your content and privacy

We do not monitor, log or store the websites you visit, the content of your traffic, or your DNS queries. What we do collect, and why, is set out in the Privacy Policy, which forms part of these Terms.

10. Intellectual property

The App, its name, logo and design belong to MarkMint Tech. You get a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control. Nothing here transfers ownership of anything to you. The App includes open-source components, which remain under their own licences.

11. No warranty

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows.

12. Limitation of liability

To the fullest extent permitted by law, MarkMint Tech is not liable for any indirect, incidental, special or consequential loss, or for lost profits, data, or goodwill, arising from your use of or inability to use the App. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim, or USD 50, whichever is greater.

Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

13. Ending this agreement

You may stop at any time by uninstalling the App. We may suspend or end your access if you breach these Terms, or if we discontinue the service. Sections that by their nature should survive — acceptable use, no warranty, limitation of liability and governing law — continue to apply after this agreement ends.

14. Changes

We may update these Terms. The date at the top changes when we do, and material changes will be announced in the App. Continuing to use the App after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Pakistan have jurisdiction. If you are a consumer, this does not remove any protection you have under the mandatory law of the country you live in.

16. Apple App Store

For the iOS version: this agreement is between you and MarkMint Tech, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
